Terms & Conditions

Last updated: October 8, 2026

These terms govern your use of commandwebworks.com and the website design services provided by Command WebWorks (“we,” “us,” or “our”). Command WebWorks is independently owned and operated by David Zinni, Sole Proprietor, New Bern, North Carolina. By using this website, contacting us, or hiring us, you agree to these terms.

Our services

We design, build, and launch websites for small businesses, and offer optional ongoing maintenance through a Care Plan. The specific scope, price, and timeline for your project are set out in the proposal or invoice we send you. If anything in that document conflicts with these terms, that document controls for your project.

Quotes, pricing, and payment

Your responsibilities

To keep a project on schedule, you agree to provide content, photos, feedback, and approvals in a reasonable time. You confirm that any content you give us — text, photos, logos, videos, reviews — is yours to use, or that you have permission to use it. You are responsible for the accuracy of business information you provide, including licenses, service areas, hours, and pricing.

Revisions and scope

Each package includes a set number of revision rounds, stated in your proposal. Additional revisions, added pages, or work outside the agreed scope may be quoted separately before it is performed. Nothing outside the agreed scope is billed without your approval first.

Timeline

We aim to launch most sites in about two weeks from the intake call. Timelines depend on receiving content and feedback from you. Delays in providing materials or approvals will extend the schedule.

Ownership

On final payment, you own the finished website and its content, and the domain is registered in your name. We retain ownership of any underlying tools, code libraries, frameworks, or templates we use across multiple projects, and of our own trademarks and branding. We may display your finished website in our portfolio and marketing unless you ask us in writing not to.

Hosting, domains, and third-party services

Websites are hosted on third-party platforms and domains are registered through third-party registrars. Those services have their own terms, pricing, and uptime commitments, and we do not control them. We are not responsible for outages, price changes, or policy changes by those providers.

Cancellation and refunds

You may cancel a project at any time before launch. The initial payment covers work already performed and is non-refundable, but you will not be billed for the balance. If we cancel a project for any reason other than non-payment, we will refund any amount paid for work not yet performed.

SMS messaging program

You can opt in to text messages from Command WebWorks in one of two ways: (1) by checking the optional, unchecked-by-default SMS consent box on our website contact form or project intake form, or (2) by texting our business number, (252) 675-4562, first about a website inquiry. By opting in, you agree to receive recurring text messages from Command WebWorks about your website inquiry, appointments, and project updates. These messages are conversational and service-related. We do not send marketing texts, and we do not text anyone who has not opted in.

See our Privacy Policy for how we handle mobile numbers. We do not share them with third parties for marketing purposes.

Acceptable use

You may not use this website or our services to break the law, infringe anyone's rights, transmit malicious code, or attempt to gain unauthorized access to our systems. We may decline or end work on any project we believe involves illegal activity, fraud, or content we are not willing to publish.

Disclaimer

We build websites to a professional standard, but we do not guarantee any particular business result — including search engine rankings, traffic volume, lead volume, or revenue. Search engines, social platforms, and advertising networks are outside our control. This website and our services are provided “as is,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to a project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of content you provided to us, including claims of copyright or trademark infringement, defamation, or false advertising.

Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Craven County, North Carolina.

Changes to these terms

We may update these terms from time to time. The version posted here at the time you engage us governs your project. We will change the “last updated” date when we make changes.
